These Terms of Service (“Terms”) form a binding agreement between you and TableReq— the trading name under which [your full name] operates as a self-employed sole trader registered in Latvia (tax registration No. [VID registration number]) (“TableReq”, “we”, “us” or “our”) — governing your access to and use of the TableReq website and table-service platform (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Definitions
- Owner — the person or business that registers a TableReq account and is responsible for it.
- Staff — individuals the Owner authorises to use the staff dashboard via a shared login.
- Guest — a diner who scans a QR code to send a service request.
- Subscription — a paid plan (Starter, Growth, or Pro) that grants access to the Service.
2. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract to use the Service. You agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials — including any shared staff credentials you create — and for all activity that occurs under your account. Notify us promptly of any unauthorised use.
3. The Service
TableReq lets restaurants generate QR codes for their tables so guests can send service requests that appear on a live staff dashboard. Features available to you depend on your Subscription plan, including limits on the number of tables. We may improve, change, or discontinue features over time.
4. Free trial
We may offer a 7-day free trial. Unless you cancel before the trial ends, your Subscription will begin automatically and the payment method on file will be charged for the applicable plan. We reserve the right to determine trial eligibility and to modify or withdraw a trial offer.
5. Subscriptions, billing, and payment
- Subscriptions are billed on a recurring monthly basis in advance through our payment processor, Stripe.
- By subscribing, you authorise us (via Stripe) to charge your payment method for the plan you select, including applicable taxes, until you cancel.
- Fees are stated exclusive of taxes unless otherwise indicated; you are responsible for any applicable VAT or other taxes.
- If a payment fails, we may retry, suspend, or downgrade your access until the amount due is paid.
- Upgrades take effect immediately and may be prorated. To change or downgrade a plan, use the billing dashboard or contact support.
6. Cancellation and refunds
You may cancel your Subscription at any time from the billing dashboard, which uses Stripe’s secure billing portal. Cancellation takes effect at the end of the current billing period, and you retain access until then. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods.
7. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- attempt to gain unauthorised access to the Service, other accounts, or its underlying systems;
- interfere with, disrupt, or overload the Service, or circumvent plan limits or security measures;
- copy, resell, sublicense, reverse-engineer, or create derivative works from the Service except as permitted by law; or
- misuse guest-facing request functionality in a way that is deceptive or violates others’ rights.
8. Your responsibilities and content
You are responsible for your use of the Service, for your Staff’s use, and for the content you enter (such as restaurant and table names). You represent that you have the right to use that content and that it does not infringe any third-party rights or applicable law. You are responsible for complying with laws that apply to your business, including informing your Guests about how requests are handled, and for your own privacy obligations toward your Guests.
9. Intellectual property
The Service, including its software, design, and branding, is owned by TableReq and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your Subscription in accordance with these Terms. All rights not expressly granted are reserved. Content you provide remains yours; you grant us the limited licence necessary to operate and provide the Service to you.
10. Availability and disclaimers
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. This does not affect any statutory rights that cannot be excluded under applicable law.
11. Limitation of liability
To the maximum extent permitted by law, TableReq will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless TableReq and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your breach of these Terms or of applicable law.
13. Suspension and termination
We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or others. You may stop using the Service at any time by cancelling your Subscription. Upon termination, your right to use the Service ends; provisions that by their nature should survive (including payment obligations, disclaimers, and limitations of liability) will continue to apply.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Latvia, without regard to its conflict-of-law rules. The courts of Latvia will have jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer-protection rights you may have in your country of residence.
